With more farm information being collected, transferred and analyzed than ever before, there is increased risk that valuable data can be lost or mismanaged. Keeping customers’ information secure is a priority for dealers and is essential for maintaining customers’ confidence in the dealership, but it can be challenging to set up the internal policies and agreements necessary to protect this data.

Two attorneys with first-hand experience helping dealers prevent precision disasters will provide actionable tips for insulating your dealership from potentially costly precision liability at the 2016 Precision Farming Dealer Summit from Jan. 5-6 in Indianapolis, Ind.

Lance Formwalt is an attorney at Siegfried Bingham in Kansas City, Mo., and serves as legal counsel for a number of farm equipment dealerships and North American dealer associations, where he helps dealers implement privacy policies and agreements that reduce the risk involved with handling precision data and customer information. He says this is “partly a legal issue and partly a customer relations issue,” and dealers need their customers to have confidence that their information is safe.

Todd Janzen is an attorney at Plews Shadley Racher & Braun in Indianapolis, Ind., and an experienced practitioner in agricultural law. He recently worked with the American Farm Bureau Federation to develop the Privacy and Security Principles for Farm Data agreement signed by over 30 ag technology providers. He says data ownership needs to be clearly spelt out to remove guesswork and will provide tips for avoiding ownership ambiguity through detailed agreements and discuss potential data dilemmas dealers should keep on their radar.
